HOLIDAY PAY RULING UPDATE

For those of you who lodged grievances for underpayment of holiday pay, we attach a draft example calculation so that you can see the information you need to provide to HR no later than 15th May 2015. 

It is imperative that this deadline is met.  

Please note that the inclusion of overtime and/or travelling time in the calculation of holiday pay only applies to the first 20 days leave (inc. of bank holidays) in each holiday year.   

Therefore you only need to calculate the overtime/travel time payments for the first 20 days leave.  The attached example only covers overtime but you can add any payments for travel time that you may be entitled to, in the same way. 

Please note that whilst the example suggests that you claim for the full 20 days for the holiday year 2014-15, there is a chance that the MOD take issue with paying the full 20 days because legal time limits dictate that if there is a gap of more than 3 months between holiday payments being made then you are very unlikely to be entitled to the earlier payments.

Further to the original circular published 24 April, we sincerely apologies for the miscalculations in paragraghs 8 & 11 of ANNEX B, which have now been rectified and re-published (this example was drawn from several documents).
